摘要
禁止权利滥用原则是民法的基本原则之一,但其在适用过程中面临着原则抽象化以及适用滥用化的双重困难。解决好禁止权利滥用原则的功能化和类型化两个方面的问题,才能既不使禁止权利滥用原则流于空洞的形式化,又不至于由于禁止权利滥用原则没有"边界"而使其在司法实践中过于泛滥。
Prohibition of rights abuse principle is the basis in civil law. But in its adaptation process, there are the difficulties of abstract principles and rights abuse. Only when the problems of functions and types ofrights abuse principle are solved, can we avoid its empty flow because of the prohibition and proliferation in judicial practice.
