摘要
配偶权是指法律赋予的夫妻互为权利义务主体的身份权,其他任何人均不得侵犯。我国现行《婚姻法》对配偶权的规定过于简单、笼统,尤其是漠视夫妻关系的自然属性,并对配偶权缺乏有效的保护机制,因而有待完善。完善配偶权,主要应充实配偶权的具体内容,并设计相应的救济方法。
＂Spouse right＂ refers to the right that the law gives the spouses mutual rights and obligations, and no other person is allowed to violate them. In China＇s current ＂Marriage Law＂, the definition of spouse right is too simple and unclear and, in particular, ignores the natural attribute of a married couple. Therefore, effective protection mechanisms for spouse right are unavailable, or are to be improved.
