摘要
家庭监禁作为一种中间制裁形式,通过维持矫正对象的主要社会关系和社会支持网络的方式,有利于重塑矫正对象的健康人格,实现刑罚个别化,避免家庭破裂,有效阻断常规监禁环境中的"交叉感染",并能降低改造罪犯的成本。家庭监禁在我国的探索适用应注重与社区矫正结合,明确其法律地位,慎重划定适用对象,并需建立起监督规则、判前调查制度和执行程序。
Family imprisonment, as a form of intermediate sanctions, through keeping the major social relationship and society-supporting net of correcting object, is beneficial to reform the healthy personality of the correcting ob-ject, to realize individual punishment, to avoid broken family, to stop effectively “the cross-infection” in regular imprisonment, to decrease the cost of criminal remould. The application of family imprisonment in China should be mixed with community correction to make sure the legal position of the object, to divide cautiously the suitable ob-jects, to set up supervisor rules, pre-sentence investigation system and implementation procedure.
