摘要
我国事故犯罪的刑罚配置与国外事故犯罪的刑罚配置相比,既有相同点也存在差异性,通过对两者进行比较研究,不仅可以对事故犯罪的刑罚配置作出正确的界定,而且可以促进我国刑事立法与刑事司法更为完善。笔者认为,我国事故犯罪的刑罚配置存在结构性的缺陷,应当予以完善。
Compared Chinese punishment configuration of accident crime with foreign countries＇, some common points and differences between them can be exposed. Through comparative research, not only can we correctly define the punishment configuration of accident crime, but also accelerate the development of legislation and justice of Chinese criminal law. In ray opinion, there is a structural defect in ours punishment configuration. Therefore, this article raises some material measures to perfect our nation＇s legislation about accident Crime.
