摘要
研究目的:通过对浙江省2001至2003年基本农田易地代保案例和美国马里兰州Calvert县1978年至2003年TDR项目案例的比较,分析在不同的土地所有制背景、土地管理体制下中美规划管理模式突变的异同,以期对完善土地利用规划管理模式有进一步启发。研究方法:实证分析和案例分析。研究结论:两个案例都是源于因经济、人口增长和变化而对土地用途分区管理的突破,并基于市场运作,但两个案例在转移的权利性质、市场参与的深度、转移内容供给和对资源配置的影响程度有很大差异。案例的进一步推行则取决于不同国家政府基于资源状况、发展压力的分析所做出的宏观决策。进一步地探讨则需要借助于法律层面对基本农田有偿易地代保权利和TDR权利实质的分析,从这一角度看,TDR已有明确的含义,这也是TDR项目能够得以不断运作、推广和改进的重要原因。基本农田有偿易地代保的权利内涵从目前来看更接近于"污染物的有偿交易"。
ownership The purpose of this study is to analyze different land management mode from the viewpoint of land and land management system based on comparison of two cases - one is from the prime farmland interchange and protection in Zhejiang Province from 2001 to 2003 and the other from TDR Program in U.S from1978 to 2003. Methods of case study and empirical study were employed. The results of Calvert County indicate that the zoning breakthrough in the two cases resulted from economic and population growth and market operation. It makes great difference between the two cases in the aspect of the property of transferable rights, the depth of market participation, the supply of the transferred matter and the impact on resources allocation. The spread of the two cases would depend on the macro decision-making of the central governments based on the analysis of resource status, the pressures that development is facing. Discussion from the angle of law shall be made to deepen the research by analyzing the rights of the prime farmland interchange and protection and TDR. There existed specific meaning of TDR, which is one of the important reasons for TDR program to act, to spread and to improve all these years. The meaning of the rights in prime farmland interchange and protection is similar to ＂permits trade with each other on pollution＂.
