摘要
在构建和谐社会的过程中,刑法应积极发挥其维持社会秩序的机能。在实现社会控制的过程中,刑法的自由保障机能与社会秩序维持机能之间存在着一定的冲突。该冲突体现为自由与秩序的二律背反,其实质是个人与社会之间的对立。在和谐社会视野中,当自由保障机能与社会秩序维持机能发生冲突时,应当优先选择自由保障机能。
During the building of a harmonious society, criminal law should fully fulfill its function of maintaining social order. There is certain conflict between its function of securing freedom and maintaining social order during the process of social control. This conflict manifests itself as the antinomy between freedom and order which is actually the conflict between an individual and the society. When conflicts occur between the function of securing freedom and maintaining social order, the preference should be the function of securing freedom in order to build a harmonious society.
