摘要
随着基因技术的飞速发展,基因权将成为人类21世纪的一项新型权利,这项权利包括两大方面的内容,即关于基因资源权和基因技术知识产权。关于基因资源权的保护,应该针对我国的国情,通过修改宪法有关资源所有权的条款、确立新的资源所有权机制、制定专门的基因资源保护法等来实现。关于基因技术知识产权的保护,应采取综合保护战略,实现全方面的保护,特别是对农民群体的有关权利的保护。此外还有基因隐私权的保护,基因产品消费、使用过程中的安全权的保护问题。
Along with the rapid development of gene technology, the gene power will become a new right of the human in 21st century, this right includes two aspects, one is about gene resources power, the other is gene technical knowledge property right.As to the gene resources power protection, we should aim at our country＇ s national condition, through revising the constitution related to the provision of resources property rights, establishing the new resources property rights mechanism, formulating special gene conservation law and so on to make it he realized. About the gene technical knowledge property right protection, we should adopt the synthesis protection strategy to realize the entire aspect protection, specially to farmer community＇ s related right protection. In addition, it also has the problems of the gene right on privacy protection, gene product expense, and the power protection of security factors in using.
