摘要
目的:探讨责任能力与作案特征、作案时精神症状的相关性。方法:通过使用精神疾病患者限定刑事责任能力评定量表及简明精神病评定量表(BPRS)等工具,对504例刑事案件鉴定案例的责任能力、作案特征及作案时精神症状进行相关分析。结果:责任能力与BPRS中精神病性症状的相关性较大(0.5<r<0.8,P<0.01);除作案时情绪反应外(r=0.228,P<0.01),责任能力与评定工具所反映的绝大多数作案特征之间关系密切(0.4<r<0.9,P<0.01)。作案时精神症状与作案特征之间亦存在密切关系(-0.4<r<-0.9,P<0.01)。结论:责任能力、作案特征、作案时精神症状三者之间存在密切关系。
Objective：To explore the correlation between responsibility and characters of crime and psychiatric symptoms in committing an offence Method：Correlation analysis was conducted between responsibility and characters of crime and psychiatric symptoms in committing an offence in 504 criminal eases of judicial expertise by rating scale of diminished criminal responsibility and brief psychiatric rating scale （ BPRS）. Results： Responsibility was positively related to psychiatric symptoms in BPRS （0.5 〈 r 〈 0. 8, P 〈 0. 01 ）. Apart from emotion reaction in committing an offence, there were significant correlations between responsibility and most characters of crime reflected by evaluation tools （0.4 〈 r 〈 0.9, P 〈 0.01 ）. Psychiatric symptoms in committing an offence were also correlated with characters of crime （ - 0. 4 〈 r 〈 - 0. 9, P 〈 0. 01 ）. Conclusion： There were significant correlations between responsibility and characters of crime and psychiatric symptoms in committing an offence.
