摘要
小产权房愈演愈烈,许多在农地上开发,因此耕地被非法占用,且正在急剧减少。小产权房与法律法规相冲突。为保证国家粮食安全和社会稳定,中国应根据实际情况并借鉴其他国家和地区的立法例,坚持土地利用总体规划和耕地管制制度,严格、合理地限制农用地转为建设用地。防止非法开发小产权房占用农地的现象继续蔓延。在补办手续并履行相关法律义务后,适时将小产权房纳入法治轨道,有利于此问题的解决和社会的和谐稳定。
The phenomenon of ＇smallish right property＇ developed more and more speedily and prosperously. Many ＇smallish right property＇ have been developed by using cultivated lands, hence cultivated land is dramatically reduced. It contradicts to the laws on the land management. In order to guarantee the food safety and social stability of the state, China should persist in the general planning and the controlling system of the land use; and limit the change from the use of farming land to the constructive use more restrictively and more rationally according to the actual situation for the size of the population and the limited cultivated land; and the experiences practiced in other areas or countries for the legislations of land use; so that we can preventing the creeping of the ＇ smallish right property＇. After performed the legal obligations and conducted the ish right property＇ into the rail of rule of law timely in and stability. procedures concerned, it seems that it should take the ＇ smallorder to solve this problem and benefiting the social harmony
