摘要
诉讼艺术(含审判艺术)是指在各种诉讼实践活动中,当事人和司法机关创造性地运用法律解决社会纷争的方式和方法。它是人类法律智慧的结晶和表现形态,甚至代表着法律艺术的最高成就。诉讼技巧、诉讼策略和诉讼智慧是诉讼艺术的三大形态。诉讼艺术的生长点就是人们的法律接受行为。
Litigation art is a kind of manner and technique which litigants and judicial organs used to solve the social dispute creatively in lawsuit. It is the crystallization and form of legal wisdom of human being,signing the highest achievement of legal art. The litigation skill, the litigation strategy and the litigation wisdom are the three forms of the litigation arts. And the growth point of litigation art is the legal accept behavior of people.
