摘要
现代经济法是调整国家介入市场所产生的社会关系的法律,社会公共利益是其法律本位。"市场失灵"和"政府失灵"是社会公共利益本位确立的依据。经济法社会公共利益本位的实现就是要保证经济法的立法、执法和司法要以社会公共利益为出发点和归宿,从而有效克服市场和政府的"双重失灵",进而推动经济发展和社会进步。
The Economic Law is the result of government intervention with the market. And public benefits are its foundation. Market failure and government failure are the base of establishment of public benefits. The realization of public benefits by Economic Law is to guarantee that legislation, enforcement of the law and jurisdiction should take public benefits as its aim and goal to overcome the ＂double failure＂ of the market and the government, and to improve the development of economy and the society.
