摘要
生活保护基准即最低生活保障标准不仅是日本生活保护行政展开的原点或出发点,而且是日本生活保护法所规定的生活保护请求权实现程度的重要体现和保障。从法制史的角度对日本生活保护基准的法制化过程进行梳理和分析,为我国最低生活保障标准的法制化、规范化提供借鉴和参考。
Minimum living standard, or standard of minimum living guarantee, is not only the starting point of the administrative work of guaranteeing minimum living standard in Japan, but also an important indication of the extent of realization of the right to the guarantee of minimum living standard provided for in Japanese law. Analyzing the development of the legal system of minimum living standard guarantee in Japan from the perspective of legal history will provide useful reference for China in the establishment of a standardized legal system of minimum living standard.
