摘要
现代法治社会都严格规范警察权的设立和行使——警察权的运行,防止其对公民权利的侵犯。警察权的运行应包括一般原则和具体原则两大方面。一般原则是警察权运行的目的和价值,应坚持人民主权原则、法治原则、人权原则和公共原则;具体原则是保障一般原则实现的原则,应坚持司法控制原则、程序原则、平等对待原则、责任原则、比例原则和及时、高效原则。
The setup and implementing - the functioning of police rights is strictly standardized in modern juridical society to prevent violation of the citizen rights. The functioning of police rights including general principles as well as specific principles. General principles refer to the goal and value of the police rights, including people rights, legal, human rights and fairness principles; specific principles are to ensure the realization of general principles, including justice control, procedure, equal treatment, responsibility, proportion, timeliness and efficiency principles.
