摘要
监禁刑以惩罚和改造罪犯为目标,监禁刑的执行关乎这一目标能否实现。目前我国的监禁刑执行制度缺乏人性化,容易连带剥夺犯罪人一些合法权利,此外,传统监禁模式固有的弊端也阻碍了犯人的再社会化,因此,有必要变革监禁刑执行制度,倡导行刑的人性化与社会化。
The goal of imprisonment is not only to punish the criminal, but also to reform him, making him a new man. And the execution of imprisonment herby plays an important role in achieving the goal. Our temporary execution system is not that humane, which often jointly deprives the prisoner of his legal rights other than liberty, and is apt to impede the prisoner on his way of being re--socialized. So, reform of such execution system is necessary and the humane and socialized treatment should be the key measure.
