摘要
自由贸易对环境保护日益影响,而环境措施对自由贸易冲击日甚。在WTO的多边贸易体制内,贸易与环境的冲突主要表现为规则的冲突,与贸易相关的环境措施主要分布在GATT/WTO的一系列协议中。通过典型案例实证环境保护对WTO基本原则冲击的具体体现,进而从多角度深入地剖析了WTO体制内贸易与环境法律冲突的原因。通过这两方面的实证分析,以期推导出贸易与环境法律冲突的可行性协调途径,实现贸易自由与环境保护的双赢。
The free trade influences the environment protection increasingly, and the environment measures more and more apply serious impact on the free trade. In the WTO multilateral system, the conflicts between trade and environment are mainly represented as the conflicts of rules. The trade - related environmental measures are distributed mostly over a series of agreements of GATF/WTO. This article demonstrates the concrete impacts of environment protection on the principles of WTO. Then the reasons of conflicts between the trade law and environment law in the WTO system are analyzed deeply from different perspectives. Through empirical studies from the two aspects, feasible coordination measures are expected to be deduced out to resolve the conflicts so as to realize the win - win of free trade and environment protection.
