摘要
所有法律活动,包括立法和司法以及整个法律制度都要以资源的有效配置和利用为目的,这是整个法经济学理论的核心。法学的核心思想应当是效率,以经济学方法对法律的供给、需求和效率进行分析,使其保障资源配置效率的最大化。对垄断行业的畸高收入进行法律制度规制时,应该进行成本监控和收入分配改革。
All legal activities, including legislation and the justice as well as the whole legal system, exist for the purpose of taking effective allocation and full advantage of resources. This is the core of the law and economics theory. Laws should not only take efficiency as its core idea but should analyze the supply, demand and efficiency of law through economics approaches for the sake of ensuring the maximum of the efficiency of the resource distribution when being practiced. We should control its cost and reform the income distribution, in order to restrain the abnormally high income in monopoly industries.
