摘要
随着经济的发展,商业秘密作为一种财富在市场竞争中的地位越来越高。立法和实践中为保护商业秘密提供了多种途径。其中,以竞业禁止方式保护商业秘密越来越成为一种成本低、效率高的保护方式。我国现有的竞业禁止规定还存在着诸如缺乏全国性立法、各地立法杂乱无序、法律界定不够明确、范围不清、立法过于抽象、缺乏操作性等问题。完善我国的竞业禁止制度,在法益冲突中寻求价值平衡,对保障社会经济平稳发展具有重要意义。
Business secret is a kind of properties, which is more and more important in market competition with the economy development. There are many kinds of methods to protect business secret in legislation and practice among which the system of prohibition of competition is a very effective method. There are still some defects with China＇s present legislation of prohibition of competition, such as lack of state legislation, confusion of local region legislation, lack of definite conception, lack of legal operation and etc. Reforming the prohibition of competition of China, and balancing the conflict of rights is very important to the social economy.
