摘要
强制婚检的取消引发了诸多争论,问题的实质在于婚检是强制还是自愿及如何解决与法律之间的冲突。针对取消强制婚检引发的社会问题及法律问题,文章从婚姻家庭法的视角考察,认为强制婚检有其法理依据,可减少无效婚姻,有助于结婚的禁止要件的落实,有利于实现婚姻法现有法律渊源的统一,因而有其必要性。
The abolition of compulsory premarital check-ups has triggered a lot of controversy.The essence of the problem is whether premarital check-ups have practical significance and how to resolve the legal conflict.Investigating compulsory premarital check-ups from the view of the Family Law,it has basis of legal theory.The implementation of premarital check-ups may reduce the invalid marriage and contribute to realization of the prerequisites for marriage,contribute to consistency of existing law concerned with Family Law.
