摘要
冲突法的各种理论之间存在着巨大的分歧与矛盾,我们应该在广泛的层面找到理论上的可通约性,改变旧有的范式,建立新的研究范式———法经济学的研究范式。一般而言,法经济学范式中对人的行为主要有经济人的假设、人的理性假设和机会主义的假设,其理论主要有斯密定理、规范的霍布斯定理、科斯定理和波斯纳定理,其方法主要有规范分析和实证分析相结合的方法、个人主义与集体主义相结合的方法、统计方法和博弈论方法等。
The theories of conflict of laws have large variance and contradiction between each other. We must change the old paradigm; establish the new research paradigm which is the research paradigm of Law and Economics. General speaking, the research paradigm of Law and Economics mainly has economic person hypothesis; rationality hypothesis; opportunism hypothesis to the behavior of the human being. Its theories mainly have Smith Theorem; Normative Hobbes Theorem; Coase Theorem; Posner Theorem. Its methods mainly have normative analysis and positive analysis method; individualism and collec tivism method; statistics method; game theory method.
