摘要
关于物权变动模式立法选择的争议在我国由来已久,如何解决则关系到市场流通与财产交易的安全。要构建完善的物权变动制度体系,首先应确立物权变动模式的价值目标,并在此基础上采用以形式主义为主,意思主义为例外的二元化物权变动模式,这既反映了我国现实的社会基础,又对不同的价值取向进行了有效地兼顾,照顾了不同的利益需求,同时也符合我国的立法传统。
The dispute about the legislative choice of the dualistic pattern of property right alternations has existed for a long time in China. How to solve the problem relates the security of the market distribution and the property transaction. In order to construct a good institutional framework of property right alternations, First we should establish the value goal of the pattern of property right alternations. Then we should take the dualistic pattern of the property right alternations——taking formalism primarily on this foundation and taking the meaning doctrine for the exception. It has reflected the reality social basis of our country and has given dual attention to the different value orientation effectively. It has considered the different benefit demand and simultaneously has conformed to our country＇s legislation tradition.
