摘要
证券交易信息由证券交易所收集、编排和发布,其消费存在"搭便车"问题,证券交易所对交易信息应当享有某种程度的排他性财产权利。我国现行法律制度没有对证券交易所的交易信息产权提供充足的保护。交易信息是数据库,其制作人证券交易所应当受到"特殊权利"保护,享有交易信息的提取权和再利用权。
Securities exchange information is collected, edited, and popularized by the securities exchange. And there is a ＂free rider＂ problem in the exchange information＇s consumption. Therefore, to some extent, the securities exchange should be entitled the exclusive exchange information property. The existing legal system of China can not provide enough protection for the securities exchange information property right. Securities exchange information is a database. As the maker of the database, the securities exchange should be specially protected so that the securities exchange is entitled the extraction and re--utilizatic rights of exchange information.
