摘要
在当前毒品问题情势下,应避免泛犯罪化思维,修改"无论数量多少,都应当追究刑事责任"之规定;基于罪刑均衡的要求,应当区分毒品种类与纯度而进行定罪量刑。
In recent situation of narcotic control, the generalization of crime should be avoided. The clause criminal responsibility should be affixed, regardless of the quantity＂ shall be revised. Since the drug - related crimes have their own features, the aggravation in passing sentences should be averted, It also needs to cut down the spending on narcotic control. The clauses relating to death sentence should be revised too. According to the requirement of equaling penalty to crime, the sentence shall be passed with respect to variety and purity level of drug.
