摘要
单位经济犯罪作为单位犯罪重要的组成部分,具有单位犯罪的特点,同时有经济犯罪的特点。由于1997新《刑法典》对单位犯罪的范围较为模糊,伴随着经济的发展,经济组织形式大大超出了预想的范围,司法实践中有使单位经济犯罪的主体扩大的要求,但是,学界基于不同的理论基础和构想,对单位经济犯罪的争议风起云涌,文章对单位经济犯罪的主体范围、以及在实践中单位经济犯罪问题的解决等问题进行论述,希望能够对单位经济犯罪确定罪量刑,有效地打击和遏制单位经济犯罪,维护社会主义市场经济秩序,起到积极的理论探讨作用。
Unit economic crimes as the important ingredient of unit commits a crime,having the characteristic of an unit commits a crime,as well as economic crimes.Because the range of unit committing a crime is“a new criminal code”in 1997,is accompanying development of the economy,the economic entities form has exceeded the range anticipating greatly,there are the request that the main body using unit economic crimes expands in actual kudicial practice.But,educational circles is raging like a storm owing to the different rationale and idea,to the dispute of unit economic crimes.The article discusses the subject range of unit economic crimes,as well as the solution to unit economic crimes problem in progress in practice,hoping that it is able to ascertain crime measurement of penalty to unit economic crimes,crack down on and keep unit economic crimes within limits effectively,defend the economic order in socialist market economy,and exert an effective result of theoretical discussion.
