摘要
产品缺陷是产品责任成立的一个不可缺少的构成要件,如何认定缺陷的存在,特别是生产者已对产品的危险性进行了说明和警示的情况下,是否还存在设计缺陷,两者的关系如何确定,这些都是产品责任法实践中存在困惑的问题。本文在比较研究的基础上,指出应引入消费者期望标准和风险效益标准,确立若干可供考虑的因素,对两者进行辩证分析,以准确界定产品缺陷。
Product defection is an indispensable part of product liability. In the practice of product liability law, many complex problems exist. For example, how to define the existence of product defect, especially how to define whether design defect exists when producer has mentioned the product defect and how to define the relationship between product design defect and caution defect. On the bases of comparative analysis, this article points out： consumer anticipation standard and risk benefit standard should be applied to defining certain considerable elements and dialectic analysis of product design defect and caution defect should be made in order to define product liability precisely.
