摘要
土地征用是政府为了公共利益的需要而依法强制取得他人土地并给予补偿的行为。土地征用权作为宪法特权,虽然既具有规模经济的优势,又能节约交易费用,但政府往往具有滥用和泛化土地征用权的倾向,并引发了一系列的社会问题,成为影响社会稳定的一个主要因素之一。通过对土地征用制度的阐述,深刻剖析我国土地征用制度中的缺陷,最后为完善我国土地征用制度,切实保护土地征用中的农民权利提出一些建议。
Land commandeering is the act that the government uses other people＇ s land by law and gives them compensation. As a special right given by the constitution, it has a tendency of being abused by the government as well as a tendency of being extended and thus gives rise to a series of social problems. It has become one of a major factors to affect the social steadiness, though it has the advantage of scale economy as well as economizing the cost. By the exposition of land commandeering system, this article aims to analyze the defects of the land commandeering system and try to put forward some constructive ideas about improving our country＇s regulations on land commandeering and protecting the farmer＇s right.
