摘要
有关国有企业以及一些商业行为能否享受国家及其财产豁免,一直是国际法学界关注的热点。如何在不断发展的国际经济形势下正确理解国家及其财产豁免,如何界定国家行为和商业行为,文章结合《联合国国家及其财产管辖豁免公约》内容对相关问题进行了有益的探讨。
It has long been the focus of attention of intemational law world whether state - owned enterprises and some of their commercial activities can have jurisdictional immunity of states and their property. This article probes into how to correctly understand it in the inter＇national positive development and how to define country activity and commercial activity considering ＂UN Convention on Jurisdictional Immunity of States and Their Property＂.
