摘要
我国刑法理论中传统的结果犯概念均有缺陷。结果犯,应是指以行为人出于故意或过失而实施的危害行为所造成的特定的危害结果为构成要件要素的基本罪。
The traditional concepts of consequential offense all have drawbacks. Consequential offense refers to the basic one for which the specific harmful consequence, caused by an intentional or negligent dangerous act, is the element of the constitutive requirements.
