摘要
公民身份和公民权历来是西方政治传统中的一大核心主题,其中主要有古典共和主义和自由主义两种迥异甚至相互竞争的基本范式。哈贝马斯力图借助交往行动理论和商谈伦理学等理论证成一种作为公权与私权之统一的公民权理论,从而实现对古典共和主义和自由主义的超越与整合。对此,他着重阐释了人权与人民主权的互明关系、法律与道德同源互补,并将公民权体系的构建回归公共领域,最终形成一种独特的哈氏“公民权政治学”。
The issue of citizenship and civil right is always one of the central topics of the Western political tradition. Republicanism and liberalism are the two entirely different, even competitive, theory traditions in this issue. Habermas tried to justify the civil right being a kind of unification of public right and private right by using the communicative action theory and the discourse ethics, which integrated and exceeded classic republicanism and liberalism. And in the discussion, he emphasized the interrelationship between human rights and dominion, law and morality, and constructed a civil rights system depending on the public sphere, and in the end he created a particular kind of "civil right politics".
