摘要
污点证人制度与我国自首、立功制度在本质上具有统一性。污点证人制度视野下,我国现行自首、立功制度还存在一些缺限,影响该制度功能的发挥。弥补缺限,应建立先行确认制度、确立绝对从宽原则、扩大免罪范围和增设保护制度。
The system of stained witness is unified with the system of voluntary surrender and meritorious performance in nature. From the perspective of the system of stained witness, there are flaws in the existing system of voluntary surrender and meritorious performance, which affect the function of the system To improve the system, we should establish systems which are to be absolute lenient policy, broaden the range of remitting a punishment and increase the system of safeguarding.
