摘要
刑事合议庭评议机制具有使司法民主实质化,裁判事实基础客观化,庭审实质化,防止司法腐败,抗干扰等价值和功能,其在刑事审判中的地位应当得到充分的尊重。法国重罪法庭评议机制具有阶段性,评议规则精细化,评议的秘密性得到充分体现等特点,值得我国借鉴。应当从评议分阶段进行,禁止弃权,发言顺序限定,书面表决、秘密写票等方面完善我国刑事合议庭评议机制。
