摘要
行政紧急权具有集中性、扩张性、程序的简化性三个属性。因此在紧急状态发生时,对行政紧急权力的规制变得尤为重要。本文通过对行政紧急权的属性予以分析,阐明对行政紧急权予以规制的必要性,并以此为基础,提出现代法治应通过行政程序对行政紧急权予以规制,更确切的说,以最低限度的程序正义为标准对行政紧急权予以规制。
The administrative Emergency power has three attributes： concentricity and expansion and simplification of procedure. Therefore at the state of emergency take place, it is very important to regulate the administrative emergency power. This paper analyzes the attributes of the administrative emergency power , clarifies the necessity of regulating the administrative emergency power, and take this as foundation, puts forward the modem rule of law should regulate the administrative emergency power through regulate the administrative procedure, or more accurately, should the administrative emergency power through the procedural justice of the lowest limit.
