摘要
令状制度是英国法治的一项基础性制度,不仅对整个普通法系有着重要影响,而且对当下我国的司法改革的实践也有一定的借鉴意义。从法理学的角度对其从发挥作用到退出历史舞台的过程进行分析将有助于全面掌握令状制度。特别是借助于谱系化考察的方法有助于各个流派之间的“商谈”,这是该制度对中国法治建设的重要借鉴意义之所在。
The writ system is fundamental for rule of law in England and has made great influence on the whole world of common-law system, which is also should be used for reference in domestic practice of judicial reforms. The jurisprudential analysis of such system from how it operated to how it finished in history would be profited for our complete understanding such system, esp. the pedigree examination will be helpful for the debate among various schools, and this should be used for reference in domestic practice of construction of rule of law.
