摘要
随着经济的发展和时代的进步,《继承法》中关于法定继承的规定显得越来越不能适应社会现实,尤其在法定继承人范围与顺序的问题上表现得更为突出。本文针对现实中存在的问题,提出将直系子女卑血亲列入法定继承人的范围,并应当列为第二顺序继承人;将三等亲列为法定继承人,按亲等的划分将之放在二等亲之后,作为第三顺序继承人。
Abstract： Legal inherit is the popular way in practice, but with the development of economical and the process of times, the Inherit Law made in 1985 cannot be adjusted to the practice more and more, especially on the range and sequence. This paper focuses on the problem appearing in practice, points out that the lineal humble family should be listed in the range and be the second turn, and the third class family should also be in the range and become the third turn.
