摘要
术语意义上的“补贴”在不同语境之下其语义存在差异。WTO法项下《补贴与反补贴措施协定》里所界定的“补贴”并不完全等价于日常经济生活中所理解的“补贴”。正确理解构成WTO法项下“补贴”的法律条件、正确理解补贴的两个分类——禁止补贴和可诉补贴,对于澄清人们仍然存在的错误认识至关重要,避免因误解“补贴”而造成政策导向失误。
The terminology of subsidy has different shades of meaning in different context. The legal condition of ＂subsidy＂ under VVfO law is the key factor. This article is to clarify the inaccurate understanding about the term ＂subsidy＂ and, to avoid some errors in policy due to the misunderstanding of the terminology of subsidy.
