摘要
日常家事代理制度是调整夫妻权利义务关系的一种重要法律制度,至今为许多国家立法所认肯,但我国现行婚姻法对此未予规定。本文通过比较国外及台湾地区的相关规定论述了日常家事代理权的概念、性质、特征及我国应增设家事代理制度的必要性,并就其立法设计提出了建议。
The agent right to the daily domestic housework is an important regulation which can adjust husband - wife relation, which has been pledged to legislate in many countries, but not in our current marriage law. After discussing the comparisons in some relevant regulations in different countries and Taiwan region , the author make an analysis on the concept, nature, character, necessary of the agent right to the daily domestic housework regulation , and also puts forward the legislative suggestion to perfect the system.
