摘要
恢复性司法作为一种西方话语,有其独特的问题意识和方案指向,而中国刑事法治的背景与西方国家有着很大的不同,因此在中国倡导恢复性司法,有必要立足于中国的法治现实。在这样一种思路下构建中国的恢复性司法,程序控制下的权力主导型方案可以说是一个不错的选择。
As a western term, restorative justice has its unique sense of crucial points and guiding references. However, the background of Chinese criminal rule of law is greatly different from those of western countries, therefore, to advocate restorative justice in China should base on our national reality of rule of law. To construct Chinese restorative justice under such a thinking pattern, it is a good choice to adopt the authority-leading plan under the control of procedures.
