摘要
法律与道德的关系是法学家不可回避的问题,因为对两者的关系的不同回答而形成了不同的法学流派。西方的自然法学派与分析实证法学派在这方面持有相反的意见;而我国传统采取的是“德主刑辅”的态度,法律几乎没有走上独立发展的道路。中西法律文化中法律与道德的关系既有差异又有暗合,并且逐步向统一化方向发展。
The relation of law and morality must be studied for legists. There are different schools because they have different opinions about the relation of law and morality. Natural law school and positive law school have different opinions and we had the attitude that morality is supplement and penalty is principal in ancient times and law couldn＇t develop independently. The relation of law and morality has both difference and accord in Chinese and western legal culture and develop in harmony.
