摘要
危险犯是刑法理论中一个很重要的课题,我们可以以危险犯的性质为契机,在评析大陆刑法理论关于危险犯的三种概念表述的基础上,认定危险犯具有的是行为属性,而非结果属性,从而明确危险犯是指行为人的行为只要造成一定的法益侵害危险,就构成犯罪既遂的情形。
Dangerous criminal is an important item in criminal law. Taking the character of dangerous criminal as a chance, we could identify the dangerous criminal as action instead of result, on the basis of three concepts evaluated and analyzed in Chinese criminal law. As the result, we clarify the dangerous criminal concept, which means that if the person has taken illegal action, he or she must be guilty.
