摘要
文章认为,对于寄宿的未成年学生,学校应当承担监护职责。学生伤害事故中的学校责任的归责原则为过错原则,在第三人侵权致未成年学生遭受人身损害的情形之下,学校承担的则是补充赔偿责任,赔偿的范围应当包括精神损害。
This article holds that the school should assume custody duty for the boarding minor students. In campus injuries the schools take on the liability according to the doctrine of fault - liability. If the minor students＇ injuries are caused by third persons, the schools liability is supplemental. The damages include emotional distress.
