摘要
文化权利在国际人权体系中构成特定的类别,其重要内涵就是少数民族保持其文化特性的权利。不同学者对少数民族文化权利有不同的看法,但多数认为指中国内部的各个少数民族保持自己的文化特征、发展自己的文化的权利。该权利应主要被界定为一种私权;它是一种个人权利,更是一种集体权利;它是一种静态权利,更是一种动态权利。在中国的现代化进程中,我们更要加强对少数民族文化权利的保障。
The cultural rights are the special kind in the international human rights, with the essence of keeping its features in culture, As for the definition of the culture rights of ethnic minorities, different scholars have different opinions. The mainly opinion is that the ethnic minorities of China have rights to maintain the features of their culture and develop it. These fights are a kind of private right, and a kind of individual right as well as a kind of eoUectiv~ right, and a kind of static right as well as a kind of dynamic right. As the industrialization of China goes, we should reinforce the protection of ethnic minorities cultural fights.
