摘要 农民工欠薪问题社会化有法律、社会等诸多原因,目前的清欠方式是以行政方式为主,效果虽显著,但要建立保护农民工劳动保酬权的长效机制还须调整现行的法律模式,将二元模式一元化;从而确立农民工与其他劳动者平等的法律地位。 There are both legal and social reasons of universal overdue payment of farmer workers working in urban area. It is obvious to achieve better results that the action of administration policy is carried out to clear the overdue payment of the farmer workers. However, the long acting mechanism of guarantee system for the due-payment for the farmer workers should be fixed up. This guarantee system should be on the basis concerning the labor law about the relationship of employer and employee. The unified management mode is based on the dual modes between the relationship of employer and employee and the labor law and the civil law and labor contract. Thus the main position of equal right of legal ranks for farmer workers and other urban workers would be equal.
