摘要
驰名商标代表了良好的信誉和对消费者的特殊吸引力。使用与驰名商标相同或近似商标的“搭便车”行为是对驰名商标的淡化,具有很多危害性。通过建立防御商标制度,禁止以他人的驰名商标作为域名注册,禁止他人将驰名商标作为企业的名称的一部分使用,加强行政执法机构的建设和加大执法力度等措施可以加强对驰名商标的反淡化保护。
A well-known trade mark represents a good reputation and a special attraction to the tonsureera. The behavior of using the same or a similar mark is like taking an incidental bus, It is harmful and dilutes the well-known trade mark. The thesis elaborates the positive significance of the anti-dilution protection and the present situation in our country. It also brings up some measures to perfect wellknown trade mark in anti-dilution protection.
