摘要
我国《公务员法》的颁布具有重大的现实意义和时代导向性。其中,交流与回避制度的精细化、申诉制度的进一步完善、聘任制的确立以及下级对上级说“不”的制度安排,都成为人们赞许和圈点的理由。不过,《公务员法》调整范围的拓展,即公务员的泛化与非专业化,却有违分类管理的发展趋势和时代要求,也必将引发理论上的无谓纷争和现实中的执法混乱。因此,针对该问题展开比较法、行政法、宪法以及立法目的意义上的学术反思,不但有利于公务员制度自身的完善与良性发展,而且必将会对我国时下的宪政改革和法治建设提供智识支持。
The official servant law of the People＇s Republic of China has important real meaning and guidance, Among these systems such as concrete of exchanging and avoiding system, further improving complaints system, establishing probation system and the system arrangement of low say No to higher become the reason of praising and special attention. But the expansion of adjusting scope of official servant law, namely the official servant＇ s expansion and nonprofessional, disobeying the development trend that classification management and request of ages, also willing cause the theoretically meaningless conflict necessarily with actuality inside of enforce the law confusion. Therefore, aim at that problem launch to criticize in scholarship from compare law, administrative law, constitution and lawmaking purpose, not only benefit to the official servant system oneself perfect and positive development, but also willing provide the knowledge and support for our present constitutionalism reform and law development.
