摘要
邓正来所著《中国法学向何处去》集中批判了法学的现代化范式,但是现代化范式在中国目前具有其必然性与合理性。而邓正来在书中所体现出来的国别主义则无法对抗普遍主义。当然,学理的讨论还是应该在一定条件下继续推进。
Where Chinese Jurisprudence Will Go written by Deng Zhenglai mainly criticizes modern paradigm of jurisprudence, but which is necessary and rational in China. The idea basic of national state in Deng Zhenglai＇s book can not resist universalism. Of course, debate about theory should be advanced under certain conditions.
