摘要
司法必须保持独立,不受外部因素的干扰。而依据宪法和其他法律,舆论可以监督司法,司法应该接受舆论监督。舆论监督应以不影响司法独立为界,应妥善处理两者之间的关系。
Judicature must keep free from disturbing by other elements as a basic system in judicial act, but public opinions can supervise judicature according to the Constitution and the other laws. How to understand the relationship？ The article analyze the theory of public opinions＇supervision on judicature and judicial independence from public opinions. The article offers some advice to solve the relationship suitably ,while insisting that judicature should accept public opinions＇supervision without disturbing judicial independence.
