摘要
《道路交通安全法》颁布实施两年来,第76条的运行实效究竟如何?作者从法律运行实效的视角,运用法律社会学的法律实效理论的分析框架和研究方法,创造性地提出法律实效评判的内在标准和外在标准,依托权威性的“社会事实”,兼采经验实证与逻辑推理的方法,揭示该76条在运行中取得的良好实效。
What effect in the world has Article 76 had since the Law on Road Traffic Safety came into effect two years ago？ From the perspective of effective enforcement and by employing analytical framework and study methods used to study the theory of effective enforcement in legal sociology, the author creatively puts forward internal and external criteria for evaluation of effective enforcement. Based on authoritative＂social facts＂ and combining empirical analysis and logical reasoning, the author reveals good effects of Article 76 in the actual operation.
