摘要
目的探讨性自我防卫能力在司法鉴定中的评定。方法采用自制调查表对105例性防卫能力分为性自我防卫能力丧失组、性自我防卫能力削弱组、性自我防卫能力存在组并进行相关资料分析。结果对三组案发当时受害人是否有反抗、以及案发后是否主动报案、赔偿态度,智商及平时的社会适应能力状况进行比较,存在显著差异(P＜0．01)。结论在进行性自我防卫能力评定时,应把受害人在案发当时智力、社会适应能力及对性行为的性质、后果的理解能力、相关量表评定结合起来综合评价。
Objective： To probe into the assessment on sexual self - defense ability in forensic psychiatric assessment. Methods： Dividing the 105 cases of sexual self - defense ability into the ability - lost category, the ability- weakened category, and the ability- existing category with the self- designed questionnaire and then analyzing the relevant reference. Results： Comparison can be made among the three categories from the aspects of victim~ revoh at the crime committing, active reporting after the crime, attitude toward the compensation, IQand the normal ability of adapting to the society, which shows remarkable difference （P 〈 0. 01 ）. Conclusion： When sexual self - defense ability is assessed, for the victim, the intelligence, the ability of adapting to society, the understanding ability to the character and sequence of the sexual behavior at the crime committing and the relevant evaluation of rating scale should be assessed together.
