摘要
以拓宽原告资格为特色的环境公益诉讼制度的构建是维护环境公益的必需。目前我国缺失对环境公益诉讼原告资格的法律规定,从而使环境公益的司法救济受限于传统诉讼法狭义、严格的原告资格概念。应当借鉴国外对环境公益诉讼原告资格的规定,拓宽原告资格,抛弃“直接利害关系人”说,扩大对环境行政行为的司法审查范围,扩展“实际损害”的范围,承认环境保护团体以及其他公益组织的原告资格,赋予当代人保护后代人合理的环境资源福利需求的起诉权,从实体与程序两方面采取有利于保障环境公益诉讼原告资格措施,从而建构我国关于环境公益诉讼原告资格的法律制度。
Establishment of environmental public welfare litigation system with the characteristics of widcning declarant qualification is necessary to maintain environmental public welfare. Currently, China does not have legal regulation of environmental public welfare litigation declarant qualification to make judicial relief of environmental public welfare limited by traditional litigation Law and strict declarant qualification concept. The author holds that China should learn from foreign regulations about environmental public welfare litigation declarant qualification, widen declarant qualification, discard "direct interested person" regulation, enlarge judicial examination scope of environmental administration behaviors, enlarge scope of " actual loss", recognize declarant qualification of environmental protection team and other pubhc organization, entrust reasonable right of action for modern people to protect environmental resources for the demand of future generations, take measures favorable to protect environmental public welfare declarant qualification in the two aspects of substance and procedure, and construct lawful system of China's environmental public welfare litigation declarant qualification.
