摘要
随着我国房地产业迅速发展和物业管理服务的市场化,物业纠纷案件不断增多。文章试图对我国住宅管理中存在的管理权、管理责任、管理费、代收代缴等各种纠纷进行总结,从物业管理体制不完善、物业公司和业主观念错位、物业公司和公用企业、公共管理部门的关系未理顺等多角度探析各种纠纷产生的原因,并提出解决各种物业管理纠纷的基本思路和遏制物业管理纠纷的法律对策。
Real assets managerial disputes have increased with the fast development of real assets industry and the marketing of real assets managerial service in China. The article summarizes the disputes in real assets management including managerial right, managing responsibilities, management expenses and the agent's collecting and payment of real assets management expenses on behalf of the owners. The causes of real assets managerial disputes are probed via defective real assets management system, the mistaken concepts of real assets company and the owners, and the indeterminate relationship between the real assets company, public-service enterprise, and public management departments. General guidelines to solve real assets managerial disputes and legal measures for containing the disputes are proposed.
