摘要
中国高等学校与学生之间的法律关系因为高等学校法律性质与地位的不确定性而成为一个颇受争议的问题。分析了高等学校与学生之间的存在的行政、民事以及其他法律关系,并对如何建立高等学校与学生之间和谐的法律关系提出了一系列制度构想,以期推动高等教育法治化问题的研究。
The relationship between Chinese public higher educational institutions and their students is a widely controversial problem because of the uncertainty of the legal nature and position of the institutions. The paper analyzes the relationships such as the administrative relationship, civil relationship, and other legal relationships between the two sides. The author proposes a series of systematic assumptions on how to build harmonious relationships between Chinese public higher educational institutions and their students in order to push the research of the legalization of higher education in China.
